How do I know if my pool is registered?

This is the first step in getting your pool safety certificate. It’s quick, easy and costs nothing. Have your LOT number available and go to the Queensland Government's Register Search Tool.

 

Do I have to have a fence around my pool or can I wait until 30th November 2015?

The short answer is YES. As a minimum, unless an exemption has been granted for disability and or impracticality and it is still valid, your pool and or spa* must be fenced.
1991 Local Government Standard Building By-Laws Act.
(Spa* - are capable of being filled with 300mm or more of water, have a volume of 2000 liters or more and a filtration system)

 

Can I purchase a property without a Pool Safety Certificate?

Yes. Although you can purchase a property without a Form 23 Pool Safety Certificate I advise you request the seller get this done prior to the unconditional date. The costs in getting your new pool compliant could be a lot more than you anticipated or budgeted for.

 

Can I sell a property without a Pool Safety Certificate?

Yes. You can issue the buyer a Form 36 Notice of No Pool Safety Certificate, however, in this very competitive real estate market getting your property to stand out from the competition is paramount. In this tough economic climate deals are falling over for a number of reasons so don’t add the lack of a Pool Certificate to the already long list. In order to increase your chances of success getting your pool compliancy done prior to selling can be a deal clincher.

 

What can I do prior to the inspection to assist in making my pool compliant?

There are number of checks you can perform to prepare your pool barrier as much as possible to ensure a smooth problem free inspection.

 

What happens after the inspection?

If your pool passes the test you will be issued with a Form 23 Pool Safety Certificate within 48 hours. This certificate will be loaded and will reflect on the Pool Safety Council website against your address as proof that you have a certificate. If your pool is not compliant, within 48 hours you will be issued with a Form 23 Pool Safety Non Conformity Notice with a detailed report on why your pool does not conform and what needs to be done to make it compliant.

 

If my pool is non compliant, how long do I have to get compliant after the inspection?

You have 3 months from the date the Form 26 Pool Safety Non Conformity Notice is issued to action what was required to make the pool compliant and to get me to reinspect your pool.

 

What happens if I do not comply within the 3 month period?

I will need to notify the Local Government if you do not ask me to reinspect the pool within 3 months after the notice is given. The local Government may take enforcement action, impose penalties of up to $16 500 for noncompliance or take other action

 

Can I use a different inspector?

No. It is an offence under the Building Act 1975 for the owner to ask, within 3 months after the notice is given, a person other than the initial inspector to inspect the pool for the issuing of a pool safety certificate.

 

How long do pool safety certificates last?

Non shared pool - 2 years
Shared pools - 1 year

 

Do doors or windows from my house that open up onto the pool area comply?

No. Doors and windows may no longer open onto a pool area. Doors and windows that open directly to the pool are to be at least 1200mm above the floor or must not open wider than 100mm or must have been permanently fitted with security screens. Installing door and window locks is not acceptable as they can easily be left unlocked.

 

Can I padlock any of my pool gates or doors?

No. Installing locks is not acceptable as they can easily be left unlocked

 

Is my neighbour responsible for any of the costs incurred if it involves the
boundary between our two properties?

This is always a sensitive area especially if you don’t get on with your neighbour, however, it is your responsibility to ensure that your swimming pool barrier is compliant. You need to take the corrective steps on your side of the boundary should your neighbour not be willing to assist you in getting your pool complaint even if the solution is cheaper and easier on the neighbours side.

 

Remember, the primary objective is to save lives and every possible precaution should be taken to achieve this. You may not be able to control what happens on the other side of the fence but you can control what happens on your side so do what you need to do to secure your pool. It’s also worth noting that there is a very strong possibility that your neighbour also has a pool, that it shares the same boundary fence as yours and needs your help in getting a pool certificate. Working together, therefore, may be a better and cheaper solution than working in isolation.

 

Do I need to have my pool fence reinspected if I change my pool fence even thoug
I have a certificate?

Yes. The certificate was issued against the pool barrier that is currently in place. Should you change your pool barrier it would need to be inspected to ensure it was compliant with the new laws.

 

How long does an inspection take?

This does depend on a number of factors, however, as a guide a residential property with one pool will take approximately one hour.
